Novosbed 15-Year Mattress Warranty

GoodMorning.com Inc. warrants each Novosbed mattress against defects in workmanship and materials for a period of 15 years. If, during the warranty period, your mattress is found defective due to faulty workmanship or materials, subject to the details below, it will be repaired or replaced according to the terms below.

Overview
  • The warranty period for your Novosbed mattress begins on the date of purchase and ends after 15 years.

  • Your Novosbed mattress MUST be unpacked and expanded no more than two weeks after the date of delivery; failure to do so will void this warranty.

  • If, despite normal usage and proper handling, your Novosbed mattress forms permanent indentations of more than one inch (two inches for commercial and institutional orders) within the first 10 years, and more than two inches (three inches for commercial and institutional orders) within the following five years, it will be replaced, at your option, according to the terms below.

  • Your Novosbed mattress cover will be repaired or replaced if there is damage to the fabric or zipper due to faulty workmanship or imperfections.

  • Your Novosbed mattress must be used on a suitable base as specified in this warranty.

  • If you use a Comfort+ kit, it is covered under the terms of your Novosbed mattress warranty.

  • GoodMorning.com Inc. will require that you take photos and measurements of your Novosbed mattress while processing a warranty claim.

Details
Duration

Your new Novosbed mattress is covered by a 15 Year Full Replacement Warranty. For 15 years after you purchase your new Novosbed mattress, when it has a defect covered under the warranty, we will replace or repair it. This includes all parts of the mattress. Your Novosbed mattress will be repaired or replaced at no additional cost within the first ten years of usage, and at a cost of 75% of the original purchase price between the eleventh and fifteenth year. For commercial and institutional orders your Novosbed mattress will be repaired or replaced at a cost of: 25% of the original purchase price within the first five years of usage; at a cost of 50% of the original purchase price between the sixth and tenth year of usage; and at a cost of 75% of the original purchase price between the eleventh and fifteenth year of usage.

A Comfort+ kit is warranted for a duration equivalent to the remaining warranty period associated with the Novosbed mattress with which it is used.

Validity

This warranty is valid only to the original purchaser of the product as indicated on the original sales receipt. The law tag must not be removed from original product as this identifies the product for the purpose of the warranties contained herein.

Novosbed mattresses must not be used on floors susceptible to moisture build-up such as concrete, below-grade (basement), or on floors in humid environments. Such inappropriate use can result in mold growth on the bottom of the mattress and void your warranty. Novosbed mattresses are designed for use on firm surfaces, non-spring foundations or adjustable bed bases that are structurally capable of supporting the weight of purchaser’s mattress, foundation, and user(s). The purchaser must use their Novosbed mattress on a foundation that allows air to circulate beneath it. It is the purchaser’s responsibility to maintain an adequate foundation and provide appropriate support for the mattress. Substitution or use of an improper foundation or other base upon which the mattress is placed may result in damage to the product thereby invalidating this warranty. Purchasers using a bed frame must ensure it provides sturdy support for both the mattress and foundation; including a center support and having at least 5-6 legs for queen, king and California king and 4 leg support for twin and full mattresses. Purchasers using their mattress directly on a slatted bed system must ensure that the slats are a minimum of 2 inches in width, and have gaps between them of no more than 3 inches. Queen, king, and California king platform beds and slat system bed frames used in conjunction with your Novosbed mattress require at least one center support beam. Platform beds and adjustable bases made of wired metal are not acceptable for use with Novosbed mattresses.

This warranty covers the following items during normal wear:

  1. Permanent Indentations

    1. Deterioration causing the mattress, without a Comfort+ layer installed, to have a visible indentation greater than one inch (two inches for commercial and institutional orders) within the first 10 years of normal usage, and greater than two inches (three inches for commercial and institutional orders) within the following 5 years that is not associated with an indentation or sag which results from use of an improper or unsupportive foundation or adjustable bed base.

    2. Deterioration causing the Comfort+ layer to have a visible indentation greater than one inch that is not associated with an indentation or sag which results from use of an improper or unsupportive foundation or adjustable bed base, or an existing indentation in an associated Novosbed mattress.

  2. Physical flaws within the first 10 years

    1. Any physical flaw in the mattress or Comfort+ that causes the foam material to split or crack despite normal usage and proper handling as described herein and as outlined in the Frequently Asked Questions section (this doesn’t apply to commercial or institutional orders).

    2. Any manufacturing defect in the zipper assembly or fabrics of the mattress cover.

This warranty does not cover:

  1. Improper usage

    1. Damage from use with an inadequate foundation and/or frame.

    2. Damage caused to the foam, cover, zipper or Comfort+ as a result of use with more than one Comfort+ layer.

    3. Mold or mildew caused from the use of the mattress on non breathable surface.

    4. Mattress, Comfort+, or foundation damage due to abuse, misuse or unsanitary treatment beyond reasonable use including, but not limited to, burns, cuts, tears, stains, bodily fluids, or spills.

    5. Washing any part of the cover other than the removable top portion.

    6. Non-compliance of washing instructions and handling for the cover resulting in damage to the cover or zipper.

  2. Normal increase of softness which can occur during regular use.

  3. Body indentations less than one inch (two inches for commercial and institutional orders) within the first 10 years of normal usage, and two inches (three inches for commercial and institutional orders) within the following 5 years.

  4. Complications resulting from use or inability to use product including, but not limited to, allergies, back pain, chiro alignments, and fibromyalgia.

  5. Individual comfort preferences.

  6. Height of bed due to purchaser’s bed frame or headboard.

  7. Sheet fit.

  8. Replacement of an accompanying Novosbed-brand product where only one piece is defective, unless that accompanying piece is also defective.

We do not warrant our product as a remedy for aches, pains or other health issues.

Supporting Documentation

  1. Photos

    1. Measuring Indentations: GoodMorning.com Inc. will require that the purchaser provide photos demonstrating the indentation by laying the product directly on a flat floor, and measuring the vertical distance from a flat and level string pulled tightly across the product and lightly contacting the product on opposite sides, to the lowest point of the indentation using a clearly demarcated measuring device.

    2. Physical flaws: GoodMorning.com Inc. will require several photos of any physical flaws that are the origin of a warranty claim. Photos will vary depending on the physical flaw being reported.

Repairs and Replacements

In the event a warranty claim is filed and a warranty replacement is deemed necessary, purchaser will be required to surrender the original product to GoodMorning.com Inc. at the time of replacement.

GoodMorning.com Inc. may, at its own option, repair or replace the cover provided on the Novosbed mattress. In the event that GoodMorning.com Inc. replaces the mattress cover, GoodMorning.com Inc. will replace it with the current style of cover available for the mattress, which may be of a different color or material than the original cover provided.

The warranties contained herein include the costs of shipping and handling, which are to be borne by GoodMorning.com Inc. Additional shipping charges may apply if the mattress has been moved from the original shipping destination, or if the original shipping destination is in a remote location.

Should this warranty be exercised and your product replaced and/or repaired, the warranty for the replacement product will be extended for the duration of the original Novosbed warranty only.

Our representatives or designated agents shall make the final determination regarding repair or replacement.

Please note: On occasion, minor upgrades may be made to products sold on Novosbed.com that may or may not enhance the product’s performance or advertised benefits. Such upgrades may cause minor differences between the delivered product and the advertised product, but such differences are not considered a valid reason for return.

Miscellaneous

The Consumer Product Safety Commission has created the CPSC 16 CFR Part 1633, Standard for the Flammability (Open Flame) of mattress Sets; Final Rule. It is understood that CAN/ULC-S137, Standard Method of Test for Fire Growth of mattresses (Open Flame Test) is parallel with 16 CFR Part 1633. It is understood that Novosbed mattresses have been tested and are compliant with CPSC 16 CFR Part 1633. While Novosbed mattresses are tested with the Novosbed Wood Frame Foundations to ensure flammability requirements are met, they may not be warranted for flammability on an alternate choice in foundation.

Terms and services related in this warranty shall be the purchaser’s sole and exclusive remedy should the product fail during the time frame stated herein. We make no warrant beyond those terms and conditions stated. PLEASE RETAIN THIS WARRANTY AND YOUR ORIGINAL PROOF OF PURCHASE FOR AT LEAST FIFTEEN (15) YEARS FROM YOUR DATE OF PURCHASE.

 

First and Second Generation Novosbed Mattresses

Novosbed 25-Year Mattress Warranty

Novosbed warrants each mattress for a period of 25 years, prorated against defects in workmanship and materials. If, during the warranty period, your mattress is found defective because of faulty workmanship or structural defects, subject to the details below, it will be replaced or repaired at our expense.

Summary
  • You must not store your Novosbed in a compressed format for more than 30 days after you have received it
  • You must use your Novosbed on a foundation that allows air to circulate beneath it
  • Slatted foundations must have slats no more than 3 inches wide, spaced no more than 3 inches apart
  • Solid foundations must contain ventilation holes with minimum diameter of 0.75 inches, spaced evenly throughout, no more than 2 inches apart
  • If the mattress forms permanent indentations of more than 0.5 inches within the first 5 years, or 0.75 inches within the following 20 years, we will replace it
  • You need to treat your mattress properly
Details

It is understood that this warranty does not apply to the normal increase of softness in the foam which can occur during normal breaking in, or in the case of visco-elastic memory foam, a lessening of the gradual recovery aspect of the foam, of which such lessening, should it occur, does not reduce the continual pressure reducing and pressure relief properties of the mattress. This warranty covers any physical flaw in the mattress that causes the memory foam material to split, crack or deteriorate, despite normal usage and proper handling as described herein.

This warranty covers any deterioration of the foam that may cause a permanent visual indentation of 0.5 inches or more during the first 5 years, and 0.75 inches or more over the following 20 years.

It is incumbent on the consumer to maintain the foundation and provide appropriate support for the Mattress. A proper foundation must provide airflow beneath the mattress: slatted bases must contain slats no more than 3 inches wide, spaced no more than 3 inches apart (measured from edge-to-edge); non-slatted bases (such as plywood) must contain ventilation holes a minimum of 0.75 inches in diameter, spaced evenly throughout the entire platform such that no hole is more than 2 inches away from another (measured from edge-to-edge). Substitution or use of improper foundations or other bases upon which the Mattress is placed may result in damage to the product thereby voiding this warranty.

Novosbed Memory Foam Mattresses are designed to work on a firm, solid-surface, non-spring foundation or adjustable bed base that is structurally capable of supporting the weight of purchaser’s Novosbed Mattress. Novosbed Memory Foam Mattresses must not be used directly on the floor. THEREFORE, IF PURCHASER USES THE FLOOR ONLY, INAPPROPRIATE FOUNDATIONS OR ADJUSTABLE BED BASES WITH THIS MATTRESS, SUCH USE WILL VOID THIS WARRANTY AND ALL OTHER WARRANTIES, WHETHER EXPRESSED OR IMPLIED, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. Novosbed may require purchaser to provide proof of the quality of the foundation for the Mattress if purchaser makes a claim under this warranty.

This warranty does not apply to the fire-retardant cover on the Mattress which is warranted for a period of five (5) years from the date of purchase against defects in material or workmanship nor the micro-fiber cover which is warranted for two (2) years against defects in material or workmanship. If Novosbed replaces the cover for the Mattress, Novosbed will replace it with the current style of cover available for the Mattress, which may be a different color or material than the original cover. If the Mattress or cover is physically abused, stained, damaged, burned, cut or torn, this warranty is void.

We do not warrant individual comfort preferences, sheet fit or height issues resulting from purchaser’s bed frame size or headboard style.

All warranties contained herein are void if the product is found to have been tampered with or misused by the purchaser beyond reasonable wear, and shall not apply if the product has been physically damaged intentionally or due to accident or neglect; including but not limited to damage by burns, cuts, water, stains, bodily fluids or is otherwise abnormally soiled, used or unsanitary. It is the consumer’s prerogative to protect the Mattress with a stain resistant mattress pad.

These warranties are valid only to the original purchaser of the product as indicated on the original sales invoice. The law tag must not be removed from original product as this identifies the product for the purpose of the warranties contained herein. The original invoice is required and is the only acceptable proof of purchase.

In order to provide an optimum sleeping surface this premium product contains only the finest quality materials. As with all premium sleep products, certain body conformity adaptations will take place as your Mattress adapts to your particular body shape and type and any peculiarities in your spinal alignment or bone structure. This is to be expected and is part of the performance of your Mattress. Novosbed reserves the right to make the final determination regarding repair or replacement.

Should this warranty be exercised and your product replaced and/or repaired, the warranty will not be extended.

In the event a warranty claim is filed and a warranty replacement is deemed necessary, purchaser will be required to surrender the original product to Novosbed at the time of replacement.

Terms and services related in this warranty shall be the consumers sole and exclusive remedy should the product fail during the time frame stated here in. We make no warrant beyond those terms and conditions stated. PLEASE RETAIN THIS WARRANTY AND YOUR ORIGINAL PROOF OF PURCHASE FOR AT LEAST TWENTY FIVE (25) YEARS FROM YOUR DATE OF PURCHASE.

Novosbed 1-Year Silk Duvet & Pima Sheets Warranty

GoodMorning.com Inc. (“GoodMorning.com / Novosbed”) guarantees that we will, at GoodMorning.com Inc.’s option, replace or repair purchaser’s product within 1 year of original delivery date if it is defective due to faulty workmanship or materials, subject to the limitations described herein.

This warranty does not include any damage or conditions resulting from misuse, accidents, abuse, neglect, normal wear and tear or non-compliance of the care instructions. Use of the duvet without a duvet cover will void the warranty.

During the one (1) year of this warranty, GoodMorning.com Inc. will at its option, repair or replace the product, and pay all return shipping costs. Any third party shipping expenses will not be reimbursed to the customer. Should such replacement take place, this warranty will cover that replaced product within the original one (1) year period only. Should this warranty be exercised and your product replaced and/or repaired, the warranty will not be extended or renewed.

Folding Foundation

Novosbed 20-Year Folding Foundation Warranty

Novosbed by 110Direct Incorp. (“Novosbed“) warrants that we will, at Novosbed’s option, replace or repair purchaser’s Leggett & Platt Out Of The Box™ Foundation (“Foundation”) if it is defective due to faulty workmanship or materials, subject to the limitations described in this warranty.

This warranty covers the following items during normal wear:

  • Structural damage/broken components
  • Squeaks, rattles or noises
  • Sagging that is not associated with use of an improper bed frame.

A proper bed frame must provide sturdy support for both the mattress and foundation; including a center support and having at least 6 legs. For queen, king, and cal king slatted style bed frames, it is incumbent upon purchaser to ensure that the frame utilized offers ample structural support for that particular slatted style frame. Failure to have a proper bed frame may invalidate the warranty.

Please Note: Novosbed recommends a support system high quality that is designed specifically to give slatted style bed frames additional structural support.

This warranty does not cover:

  • Structural damage from using an improper bed frame. See above description for a proper bed frame.
  • Physical abuse or damage to the structure and/or cover material, including but not limited to, burns, cuts, tears, mould or liquid damage.
Year 1 through 10 – Full Coverage

During the first ten (10) years of this warranty, Novosbed will not charge purchaser to repair or replace purchaser’s foundation if it is deemed defective, but any transportation costs associated with repairs or replacements are purchaser’s responsibility. In no event will the transportation costs exceed Novosbed’s then-standard freight charges.

Year 11 through 20 – Prorated Coverage

During years 11 through 20 of this warranty Novosbed will, at its option, repair the foundation at a handling cost to purchaser, or replace the foundation at a prorated charge to purchaser plus transportation costs. If Novosbed replaces the foundation, the prorated replacement charge purchaser pays will depend on when the foundation is replaced.

If the foundation is replaced during the eleventh year of this warranty, the prorated replacement charge purchaser pays will be fifty (50) percent of the original purchase price.

If the foundation is replaced after the eleventh year but before this warranty expires, the prorated charge purchaser pays will increase by five (5) percent for each subsequent year of the prorated period (i.e., 55% of the original purchase price if replaced during year twelve; 60% of the original purchase price if replaced during year thirteen, etc.)

Out of The Box™ foundations are designed to work in conjunction with a Novosbed or similar mattress. Out of The Box™ foundations should be placed on a bed frame that is structurally capable of supporting the weight of the purchaser’s Novosbed mattress, foundation, and user(s). IF PURCHASER USES INAPPROPRIATE BED FRAMES WITH THIS FOUNDATION, SUCH USE WILL VOID THIS WARRANTY AND ALL OTHER WARRANTIES, WHETHER EXPRESSED OR IMPLIED, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. Novosbed may require proof of the quality of bed frame if purchaser makes a claim under this warranty. Novosbed reserves the right to invalidate this warranty if the foundation is found to be in an unsanitary condition.

The Consumer Product Safety Commission has created the Standard for the Flammability (Open Flame) of Mattress Sets in Federal Register 16 CFR Part 1633. Foundations are specified for use with particular mattresses and therefore use outside of these specifications, should not be construed as 16 CFR Part 1633 compliant.

This warranty is valid only for the original purchaser from the original purchase date of the original product purchased. An original purchaser is one who purchases the product directly from Novosbed or an authorized retailer of Novosbed. If purchaser is not the original purchaser of this product, he/she takes it “as is“ and “with all faults.“

In the event a warranty claim is filed and a warranty replacement is deemed necessary, purchaser will be required to surrender the original product to Novosbed at the time of replacement.

GoodMorning.com 2-Year Limited Duvet Cover Warranty

GoodMorning.com Inc. (“GoodMorning.com”) covers your Duvet Cover (the “Product”) under a 2-year limited warranty (the “Warranty”). This limited Warranty gives you specific legal rights, and you may also have other rights which vary from province to province or state to state.

1. Who this Warranty extends to

This limited Warranty extends to the original purchaser of a Product who is located in Canada or the United States (the “Customer”). The warranty is only valid in the country where the product was purchased. Customers who buy larger quantities for commercial purposes and who are invoiced separately called “Commercial Customers” are also covered by this Warranty.  

All GoodMorning.com warranties, including any implied warranties, are valid only for the period the Product is owned by the original purchaser of the Product. The “original purchaser,” for this Warranty, is the first purchaser of the Product directly from GoodMorning.com or any other website operated by GoodMorning.com. The GoodMorning.com limited Warranty is non-transferable. 

2. Products covered by this limited Warranty

This limited Warranty extends to Products sold by GoodMorning.com, purchased directly from GoodMorning.com or any other website operated by GoodMorning.com, and located in Canada or the United States. 

This Warranty does not cover your Product if you do not use it in a manner compatible with the intended design and intended purpose in the home. Damage to the Product caused by moisture, from improper storage or use, is not covered by this Warranty. 

3. What this limited Warranty covers

This limited Warranty applies to the Product in its original packaging sold to you against the following Defects in material and workmanship, provided the Product is used for its intended purpose:

  • Any physical flaw in the Product despite normal usage and proper handling.
  • Any manufacturing defect of the Product.

This limited Warranty does not cover the following:

  • Comfort preference.
  • Physical abuse or damage to the structure and/or cover material, including but not limited to, burns, cuts, tears, liquid damage, or stains; provided, that the defect is caused by such abuse or damage.
  • Damage caused by commercial use, such as in a hotel or store – unless you are a Commercial Customer.
  • Replacement of any non-defective pieces in the GoodMorning.com Product (for example, if you purchase a product with multiple components and only one component is defective, then we will only replace the defective component).
  • Products sold “as-is”, “preconditioned”, “reconditioned”, “used”, “comfort return”, “returned”, “previously owned”, or any other similar wording indicating that the Product is not “new” or of “first quality”, or has previously been purchased or used by another consumer.

In the event of a Defect, GoodMorning.com’s sole and exclusive liability and your sole remedy under this limited Warranty will be, at GoodMorning.com’s option, to provide a repaired or replacement Product, subject to your fulfillment of “Your Responsibilities” below. Replacement products may be provided in a colour or design different from the products you originally purchased.

4. Your responsibilities

In the event of a Defect and to get the benefit of this limited Warranty, we may ask you to return your Product to GoodMorning.com and provide GoodMorning.com with proof of the original date of purchase. You must retain a copy of your receipt as proof of purchase. GoodMorning.com will arrange for shipping back the defective Product. Should any shipping or handling costs be incurred by you for return of the Product, you will not be reimbursed for those costs.

Evidence of a Defect and any claims must be sent to the address set forth at the end of this limited Warranty document. You will be required to provide several photographs of any defect that is the subject of any warranty claim. Photograph requirements will vary depending on the product and the nature of the defect. 

If a replacement is necessary, GoodMorning.com will replace your Product with the same or a similar Product only. You will be required to pay the difference between the original purchase price of the Product and that of a replacement Product, including any additional costs, if an upgraded Product is requested.

GoodMorning.com will repair or replace (as applicable) and ship your new Product or upgraded Product back to you.

Replaced or repaired Products are subject to the same limited Warranty as the original Product. If you obtain a replaced or repaired Product, the warranty term of the replaced or repaired Product begins from the date of purchase of the original Product. If you purchase an upgraded product, a new warranty term will begin upon the purchase of the upgraded Product.

The care label must not be removed from the original Product as this identifies the Product for the purpose of the warranties contained herein.

5. Disclaimer, limitation on liability

To the extent permissible by applicable law, the Product is provided “AS IS” and this Warranty and any implied warranties are your exclusive warranties and replace all other warranties or conditions, express or implied. Some provinces/states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you. 

Some states or other jurisdictions do not allow the exclusion of implied warranties, so the above exclusions may not apply to you. You may also have other rights that vary from province/state to province/state and jurisdiction to jurisdiction. 

To the maximum extent permitted by applicable law and except as set forth in this limited Warranty, in no event will GoodMorning.com or its suppliers be liable for procurement of substitute products or other special, incidental, consequential or indirect damages arising out of or related to the Product or its use by you or any third party, whether under theory of contract, tort (including negligence), indemnity, product liability or otherwise. This limitation will apply even if GoodMorning.com has been advised of such damages and notwithstanding the failure of essential purpose of any limited remedy. GoodMorning.com’s total liability will not exceed the purchase price paid for the Product giving rise to such liability.

Some provinces/states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations and exclusions may not apply to you. 

6. Arbitration

In the event a dispute arises between you and GoodMorning.com arising out of this limited Warranty, such dispute will be determined and settled by binding arbitration between the parties, in accordance with the Arbitration Act of the province of Alberta. 

You must seek arbitration for disputes arising out of this limited Warranty before exercising any rights or seeking any other remedies created by any other regulation or legislation. Arbitration will take place in Edmonton, Alberta.

The arbitration will not be combined with any other proceeding or arbitration against one of the parties. Each party will designate one arbitrator and the two designated arbitrators will select a third arbitrator, who will serve as the chair of the arbitration panel. All arbitration proceedings will be closed to the public and confidential and all related records will be permanently sealed, except as necessary to obtain court confirmation of the arbitration award. The decision and the arbitrators’ award will be in writing and will include a statement setting forth the reasons for the disposition of any claim. A dissenting decision will also be set forth in writing. The arbitrators’ award will be final and binding on the parties, and judgment thereon may be entered in any court of competent jurisdiction.

7. Governing law

This limited Duvet Cover Warranty will be governed by the laws of the province of Alberta.
