This Privacy Policy applies to GoodMorning.com, DouglasBed.ca, Novosbed.com, LoganAndCove.ca, RecoreBed.ca, BrunswickBed.ca, JunoBed.ca, PodiumBed.ca, Mattress-Reviews.com, MattressForum.com, and all other websites, applications, products, services, and other offerings (collectively, the “Services”) owned and operated by GoodMorning.com Inc. (“GoodMorning”) that post a link to this Privacy Policy.

The Privacy Policy explains how GoodMorning may collect, use, and disclose personal information we obtain through the Services, your communications with us, or from third parties. It also describes the choices and rights available to you regarding your personal information. 

What is personal information?

We consider information that identifies you as a specific, identified individual – such as your name, address, date of birth, gender, financial information, as well as your opinions, preferences, and purchase patterns – to be personal information.  We will also treat other information, including IP addresses and cookie identifiers, as “personal information” when required by applicable law.  

We may de-identify your personal information so as to make it non-personal, either by combining it with information about other individuals and/or by hashing the information or otherwise removing characteristics that make the information personally identifiable to you.  We will treat de-identified information as non-personal to the fullest extent allowed by applicable law.

Information we collect about you

We collect certain types of personal information whenever you interact with us:

Registering an account. Some of our Services give you the option of creating a user account. If you decide to create an account, you will provide us with certain personal information, such as your name, email address, user name, and password. You are not required to register to use our Services.

Purchasing a GoodMorning Product. When you make a purchase, you are given the option of creating an account while checking out. Whether you exercise this option or not, when you purchase a GoodMorning product, you will provide us with personal information, such as your name, email address, payment information, and shipping address.

Making a payment. When you make a payment to GoodMorning, you may need to provide personal information to one or more of our third-party payment processors. Such information may include sensitive personal information, such as your credit card number.

Submitting information to us. We collect information you submit to us. For example, when you post a review of a GoodMorning product on a GoodMorning website, or refer a friend to GoodMorning via a GoodMorning Product, we receive the information in your submission, including any personal information. If you choose to submit content to any public area of GoodMorning.com, such content will be considered “public” and will not be subject to the privacy protections set forth herein.

Communicating with us. We may also collect personal information from you when you communicate with us. For example, you may send us personal information by writing an email to us, calling our customer service department, chatting with our customer service department, or subscribing to one of our newsletters.

Taking a survey. From time to time, we may contact you to participate in optional online surveys. If you do decide to participate, you may be asked to provide certain information which may include personal information.

Information you provide about a third party. If you choose to use our referral service to tell a friend about GoodMorning, we may collect your friend’s personal information, such as name and email address. We will automatically send your friend a one-time email inviting him or her to purchase a GoodMorning product. We store your friend’s information in order to send this one-time email and to track the success of our referral program.

Automatic collection. We, our service providers, and other third parties collect and store information that is generated automatically as you use our Services (“Usage Information”). Usage Information may include Internet protocol (IP) addresses, mobile device identifier , cookie identifier, browser type, Internet Service Provider (ISP), referring/exit pages, the files viewed on our websites and applications (e.g., HTML pages, graphics, etc.), operating system, date/time stamp, and/or clickstream data. We use this data to analyze trends in the aggregate and administer our Services. Usage Information may be combined with other information about you, such as when you are logged into your GoodMorning account.

Tracking technologies. Usage Information is collected through the use of the following technologies:

  • Cookies and Local Storage.  Cookies and local storage are data files placed within a browser on a device when it is used to visit the Services.  Certain web browsers and browser add-ons may provide additional local data storage mechanisms.  Cookies and local storage can be used for a variety of purposes, including to store a unique identifier for your device that recognizes your device as you visit the Services or other websites or online services, and to remember your preferences.  Most browsers provide you with the ability to disable, decline, or clear cookies and local storage; please check your browser’s settings for further information.
  • Web Tags.  Small graphic images or other web programming code (also known as 1×1 GIFs or clear GIFs) may be included in our web pages and email messages.  These and similar technologies may be used for a number of purposes, including to count visitors to the Services, to monitor how users navigate Services, to count how many of our email messages were opened, or to count how many particular products were viewed.
  • Embedded Scripts. An embedded script is programming code that is designed to collect information about your interactions with the Services, such as the links you click on. The code is temporarily downloaded onto your device from our server or a third-party service provider or business partner, is active only while you are connected to our Services, and is deactivated or deleted thereafter.

In addition, we may use a variety of other technologies that collect similar information for security, fraud detection, site functionality and operational purposes.

Information provided by third parties. GoodMorning may collect information about you from third parties or supplement the information we collect from you with additional records received from third parties, such as business partners (including companies that assist us with online advertising and analytics), other customers of the Services (such as when they engage in the Refer-A-Friend feature), and data providers who enhance the information we have about you.

Social Media.  We may host or facilitate interactions with social media platforms, including Facebook, Twitter, and Instagram.  When you interact with social media through the Services, we will receive information about you from the social media service.  

In addition, the social media service may set their own cookies and collect information about your use of the Services, including your IP address or other device identifiers, and which pages you visit on the Services.  These social media platforms may be able to collect certain information on your visits to the Services regardless of whether or not you affirmatively interact with the feature and whether or not you are logged into (or have) an account with the social media platform.  If you are logged out or do not have an account and visit a page with a social plug-in, your browser sends a more limited set of information.  Like other sites, the social media platform will receive information about the webpage you are visiting, the date and time of your visit, and other browser-related information.  They may use that information to help them improve their products or for other purposes set forth in their privacy policy. We may also receive information about you if other users of social media give us access to their profiles and you are one of their connections or “friends.”

The information we collect is subject to this Privacy Policy. The information collected and stored by the third party remains subject to the third party’s privacy practices, including, without limitation, whether the third party continues to share information with us, the types of information shared, and your choices with regard to what is visible to others on that third-party website or service. The third party may allow you to remove the application or feature, in which case we will no longer collect information about you through the application or feature, but may retain the information previously collected.    

If you choose to post information to a third party platform, that information may be public.

How GoodMorning uses your information

We may use non-personal information for any purpose allowable by law, including for advertising, research, and marketing purposes.  We use personal information and Usage Information as described to you at the time of collection and use of a feature of the Services, and otherwise with your consent, and as disclosed in this privacy policy, including in the following ways:

Internal and service-related usage – to improve and facilitate our Services, including:

  • to provide the Services to you;
  • to analyze interactions with and performance of our Services;
  • to debug and identify errors that impair functionality;
  • to detect, investigate, and prevent security incidents, protecting against malicious, deceptive, fraudulent, or illegal activity;

Communications to update you on the status of your order(s), to verify your account, and for informational and operational purposes such as account management, customer service, system maintenance, and in our discretion, changes to our policies.

Legal Purposes – to comply with the law and protect the safety, rights, property, or security of GoodMorning, the Services, consumers, and the general public.

How GoodMorning shares your information

We may aggregate, de-identify, and/or anonymize any information such that it is no longer linked to your personal information.  We may share this non-personal information with third parties for any purpose, including for advertising, research, and marketing purposes.  

We do not share your personal information with third parties for those third parties’ own direct marketing purposes. GoodMorning may disclose your personal information in the following ways:

Service Providers. We may share personal information with our vendors and service providers who perform services on our behalf. These third parties are authorized to use your personal information only as necessary to provide these services to us, such as fulfilling orders, processing payments, sending and improving communications, developing and improving our Services, detecting, preventing, and remediating fraud or other prohibited activities, and other support for the provision of our Services.

At your request and when you post content publicly. We may share information when you direct us to do so.  For example, you may be presented with an opportunity to receive marketing offers from a third party, or you may choose to write a product review, refer a friend to us, or engage with a social media service or third party application or feature through which your information is shared. The content you post to our Services may be displayed on any GoodMorning website. Other users may be able to see some information about you, such as your name if you submit a review.

In addition, we may offer features, such as message boards and other public areas, where you can choose to interact with others and/or submit content or post it publicly.  Content that you post may be viewed, collected, and used by others, and the protections of this Privacy Policy will not apply.

Sweepstakes, Contests and Promotions.  We may offer sweepstakes, contests, or other promotions (any of which, a “Promotion”) that may require registration.  By participating in a Promotion, you are agreeing to the provisions, conditions, or official rules that govern the Promotion, which may contain specific requirements of you (including, except where prohibited by law, allowing the sponsor(s) of the Promotion to use your name, voice, likeness, or other indicia of persona in advertising or marketing materials).  If you choose to enter a Promotion, personal information may be disclosed to third parties or the public in connection with the administration of such Promotion, including in connection with winner selection, prize fulfillment, as required by law, or as permitted by the Promotion’s terms or official rules (such as on a winner’s list).

As required by law and similar disclosures. Advertising and Analytics 

To manage our advertising on other sites, we engage third-party advertising partners. Do Not Track Mechanisms 

Do Not Track (“DNT”) signals offered by some web browsers are settings that request that a web application disable its tracking of an individual user. There is no consensus among industry participants as to what “Do Not Track” means in this context.  Like many websites and online services, we may not alter our practices when our systems receive a “Do Not Track” signal from a visitor’s browser, except as specifically required by law. Your Choices

If you receive an unwanted marketing email from us, you can use the unsubscribe link found at the bottom of the email to opt out of receiving future emails. We will process your request within a reasonable time after receipt.  Note, however, that we reserve the right to send you certain communications relating to your use of the Services, notices of changes to this Privacy Policy or other terms, or similar administrative and transactional messages. We are not responsible for removing your personal information from the lists of any third party who has previously been provided with your information in accordance with this policy.

We do not endorse, screen, or approve, and are not responsible for the privacy practices or content of such other websites or applications. Security of your information

We take commercially reasonable steps to ensure that your information is treated securely. Unfortunately, the Internet cannot be guaranteed to be 100% secure, and we cannot ensure or warrant the security of any information you provide to us. We do not accept liability for unintentional disclosure. By using our Services or providing personal information to us, you agree that we may communicate with you electronically regarding security, privacy, and administrative issues relating to your use of our Services. If we learn of a security breach, we may notify you by posting a notice on one or more GoodMorning websites, sending an email to you, or by mail, as required by law.

General Audience Site

We do not knowingly collect, maintain, or use personal information from children under 18 years of age, and our Services are not directed to children under the age of 18. If you learn that your child has provided us with personal information without your consent, you may alert us using the contact information below. If we learn that we have collected any personal information from children under 18, we will promptly take steps to delete such information and terminate the child’s account.

Changes to our Privacy Policy and practices

We may revise this Privacy Policy, so we encourage you to review it periodically. If you continue to use our Services after such changes have been made, you hereby provide your consent to the changes.

Nevada Consumer Opt-Out Requests

Nevada S.B. 220 provides consumers with the ability to opt out of the sale of their personal information. We do not sell your personal information as defined in S.B. 220. However, you may still submit an opt-out request, and if our practices were to change in the future, we would honor your request.  If you are a Nevada resident and would like to opt out of the sale of your covered information, your request must be submitted to support@goodmorning.com. Your request must include your full name, street address, city, state, zip code, and a valid email address so that we can contact you if needed regarding your request.  If you previously provided a phone number, including it will assist us in making sure we identify you as someone who wants to opt out.  You may be required to take reasonable steps as we determine from time to time to verify your identity and/or the authenticity of your request.

This California Privacy Notice is Updated and Effective as of September 8, 2021.

This notice supplements GoodMorning’s privacy policy and applies only to California residents. This California Privacy Notice sets forth the expanded disclosures and rights for California Consumers regarding their Personal Information, as required by the California Consumer Privacy Act (“CCPA”). Terms (including defined capitalized terms) used in this California Privacy Notice have the same meanings given in the CCPA and the regulations of the Attorney General implementing the CCPA, unless otherwise defined.

Only you or your authorized representative may make these requests. You may make requests for data disclosure or portability no more than twice in a 12-month period. In your request, you must provide enough information to allow us to verify you are the person about whom we collected personal information, or their authorized representative. You must also describe your request with enough detail so that we can understand, evaluate and respond to it. We cannot respond to your request if we cannot verify your identity. Agents

EXERCISING YOUR CALIFORNIA ACCESS, DELETION, AND DO NOT SELL RIGHTS

California Consumers have the right to request: (1) that we disclose to you what Personal Information we collect, use, disclose, and sell, including the right to request that we provide to you the specific pieces of Personal Information we have collected about you in the prior 12 months (“Right to Know”); (2) that we delete the Personal Information we collect about you (“Right to Delete”); and (3) to opt-out from the sale of their Personal Information, all subject to exceptions set forth in the CCPA. More information on each of these rights is below.

Right to Know 

In accordance with the CCPA, California Consumers have the right to know what information we have collected about you.

Right to Delete 

In accordance with the CCPA, California Consumers have the right to request that we delete the information we have collected from you.  If you are a California Consumer and would like us to delete Personal Information we have collected from you, please email us at support@goodmorning.com or call 1-844-456-4506 to proceed with this request.

Verifying ‘Right to Know’ and ‘Right to Delete’ Requests

Please note that we will take steps to verify your identity in order to fulfill your request.  

In order to verify your identity, we will request that you provide:  your name, email address, and a detail about a transaction with you, such as the date or amount of your last purchase or the item you purchased.

If we are unable to verify that the individual submitting the request is the same individual about whom we have collected information (or someone authorized by that individual to act on their behalf), we will not be able to process the request.

Requests to Know

In order to have us provide specific pieces of information, we will require a signed declaration under penalty of perjury that you are the consumer whose Personal Information is the subject of the request.

Requests to Delete

To ensure that we do not delete your personal information in response to a fraudulent request, once you submit the request, we may follow up to confirm that you want your information to be deleted.

Do Not Sell

The CCPA also provides California Consumers a right to request to opt-out of the sale of Personal Information. GoodMorning does not sell consumer information to third parties for financial gain.  GoodMorning does engage in online advertising practices (and certain analytics or similar activities), such as to provide you relevant marketing messages, which may potentially be considered “sales” under the CCPA under certain circumstances.    

To help you manage the tracking of your information, including browsing history and targeted marketing efforts, you can take action by opting out of cookies and device ID tracking. To opt-out of cookies set by 3rd parties that may be considered “sales” under the CCPA, please click here to use our cookie manager tool.  Note that you will need to indicate your opt-out choices at each of our Services separately.

The Digital Advertising Alliance also offers tools for California consumers to send requests under the CCPA to opt out of the sale of personal information by some or all of the participating companies here. You can also manage privacy options directly in your device preferences or settings.

Note that all of these tools are cookie-based opt-outs. If you disable your cookies or upgrade your browser after opting out, or if you use different computers or browsers, you will need to indicate your opt-out choices across those other computers and browsers.

You may also be able to limit the access these third parties have to information about you when you use the Services by installing a browser or browser extension that can enable you to block the functionality of some tracking technologies.

Users Younger than Age 16.  GoodMorning does not knowingly sell Personal Information of minors younger than 16 years of age.

  1. Other California Privacy Rights 

California’s “Shine the Light” law (Civil Code Section 1798.83, also known as S.B. 27) allows California residents to request from companies conducting business in California certain information relating to third parties to which the company has disclosed certain categories of personal information during the preceding year for the third parties’ direct marketing purposes.  Alternatively, the law provides that a company may comply, as GoodMorning does, by disclosing in its privacy policy that it provides consumers choice (opt in or opt out) regarding sharing personal information with third parties for those third parties’ direct marking purposes, and information on how to exercise that choice.  As stated in this Privacy Policy, GoodMorning provides you choice prior to sharing your personal information with third parties for their direct marketing purposes.  If you do not opt-in or if you opt-out at the time we offer that choice, we do not share your information with that identified third party for its direct marketing purposes.
